These Terms of Service ("Terms") govern your access to and use of the website, products, and services of AVALANCHE TECHHUB LIMITED ("we", "us", or "our"), a Kenyan company registered in Nairobi under the Companies Act, 2015 (registration no. on file). We operate a Nairobi-based technology hub providing IT and technology products and services, including tech retail, software, IT services, co-working and innovation space, and developer tools.
1. Acceptance of Terms
By accessing or using our website, creating an account, or purchasing any product or service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use our services.
2. Use of the Service
- Account responsibility: you are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately of any unauthorised use.
- Lawful use: you agree to use our services only for lawful purposes and not to misuse, disrupt, or attempt to gain unauthorised access to our systems or other users' accounts.
- No redistribution of digital goods: software, licence keys, and other digital goods are licensed to you for your own use. You may not copy, resell, sublicense, or redistribute them without our prior written consent.
3. Orders and Payment
Prices are displayed in Kenyan Shillings (KES) as our primary currency, and we also support Nigerian Naira (NGN) and US Dollars (USD). Prices are inclusive of applicable taxes unless stated otherwise; you are responsible for any additional taxes, duties, or charges imposed by your jurisdiction.
Payments are processed securely through our third-party payment processor, TransactPay. By submitting an order, you authorise us and TransactPay to charge your selected payment method for the total order amount. We reserve the right to refuse or cancel any order where payment cannot be verified or where we suspect fraud.
4. Intellectual Property
All content on our website, including text, graphics, logos, software, and the arrangement thereof, is the property of AVALANCHE TECHHUB LIMITED or its licensors and is protected by applicable intellectual property laws. You may not use, reproduce, or distribute our content without our prior written permission.
5. Refunds and Cancellations
Refunds and cancellations are governed by our Refund Policy, which forms part of these Terms. Please review it before making a purchase.
6. Limitation of Liability
To the fullest extent permitted by law, AVALANCHE TECHHUB LIMITED shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, our services. Our total liability for any claim shall not exceed the amount you paid for the product or service giving rise to the claim. Nothing in these Terms limits any rights you have under the Consumer Protection Act, 2012 (Kenya) that cannot be lawfully excluded.
7. Changes to Terms
We may revise these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of our services after changes take effect constitutes acceptance of the revised Terms.
8. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, including the Consumer Protection Act, 2012. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya sitting in Nairobi.
